GENERAL TERMS AND CONDITIONS

§ 1 Scope

(1) The Gerolsteiner-Radsport-Festival 2010 is held under the supervision of TW GEROLSTEINER LAND GmbH and Ley Events GmbH.

(2) Any changes to these terms and conditions will be published online at www.gerolsteiner-radsport-festival.de. They are, in their then-current form, part of the contract between organizer and participant.


§ 2 Terms and conditions – safety measures

(1) Everyone who has reached the age of 18 is entitled to start. There are, however, the following exceptions: participants of the marathon races are entitled to start if they have reached the age of 16 and participants of the Kids Race are already entitled to start if they have reached the age of 6 provided that they can present a written declaration of consent from their parent or legal guardian. This consent has to be in form of the parent or legal guardian's signature on the registration form. If registering online, a written declaration of consent by the parent or legal guardian has to be made without the official form.

(2) Racing bicycles or equipment, such as helmets, drinking bottles, etc., not specified in the regulations, or which may in any way impair the health or safety of participants or visitors of the event, is only permitted for use with the explicit approval of the organizer.

(3) Organizational measures will be announced to the participants by the organizer prior to the start of the event. Instructions of the organizer and event staff are to be followed without exception. If these instructions are not complied with and this disrupts the orderly progress of the event or jeopardizes the safety of participants or visitors, the organizer is entitled to exclude the person or disqualify the participant in question. Legally binding declarations can be made to the participants by authorized event personnel only.


§ 3 Registration – participation fee – terms of payment – reimbursement- cancellation

(1) Registration can only be made on the homepage www.gerolsteiner-radsport-festival.de by online registration using the respective "web form" on the Internet. The registration using the online registration is binding for the participants. As long as the participant limit for the individual races hasn't been reached, late registrations can be accepted at the accreditation office of the Gerolsteiner-Radsport-Festivals.

(2) Payments can be made by direct debit only, or, in case of participants with a foreign bank account, by money transfer. In case of a late registration during accreditation payment has to be made on site.

(3) After filling out the online registration the participant will get a confirmation first. A binding contract over teh participation at this event will become effective after receiving a registration confirmation, which includes the request to pay the registration fee. The full ammount of the registration fee needs to be paid within two weeks after receiving the registration confirmation. If the registration fee is not paid within the two weeks the Organizer has the right to cancel the registration confirmation. In this case an effort compensation over € 10,00 needs to be paid. The participant has the right to proof that there was no or just little effort of the organizer.
The organizer will send a confirmation to the participant after receiving the registration application and the entry fee. The organizer reserves the right to exclude or disqualify a participant at any time, if he or she has provided false personal data, he or she is subject to a ban in Germany or if the participant is suspected of taking part in the race after having taken banned substances (doping).

(4) The right to participate is not transferable.

(5) If a registered participant does not enter the race or declares to the organizer his or her withdrawal, he or she is not entitled to a refund of the entry fee.

(6) For the Gerolsteiner-Radsport-Festival 2010 the following conditions apply to cancellations:

In case of cancellations up to and including 07.05.10, the participant will get a refund of 50% of the entry fee, in case of a later cancellations the participant will not get a refund of the entry fee.

(7) Only cancellations of the full package can be made. It is not possible to cancel individual parts of the registration.

(8) Starting positions are personalized and thus transferable only by the organizer, but not by the participant.

(9) The organizer sets a limit of 300 starters for the single time trial and 400 starters (100 teams) for the team time trial. After exceeding this limit registrations will not be accepted. Should the minimum of 200 starters for the single time trial and 50 teams for the team time trial not be reached, the organizer reserves the right to cancel the respective race(s). Under these circumstances the participants will get a full refund of the entry fee.


§ 4 Liability disclaimer 

(1) The organizer does not assume liability of any kind.

(2) Each participant takes part in the event at his or her own risk and should have insurance coverage of accidents and other damages.

(3) Claims for damages or compensation by the participant against the organizer, or any third party executing the event, are excluded.

(4) The organizer will not be liable for health risks of a participant that are in any way connected with taking part in the Gerolsteiner-Radsport-Festival 2010. It is the participant's responsibility to make sure he or she is in good health.

(5) The organizer will not be liable for lost valuables, clothing, or equipment.

(6) All participants have to return their transponders immediately after the race because it is a loan from the organizer. Should this for some important reason be impossible, the transponder can be returned by mail to Ley Events GmbH no later than 30.06.2010. In the event of loss or failure to return the transponder within the mentioned time period the organizer will charge a fee of € 75.

(7) Costs for third party services, e.g. rescue services, have to be paid for by the participant. The organizer reserves the right to charge any of these costs to the participant.


§ 5 Data acquisition and utilization / rights to photographic material

(1) Personal data provided in the registration process by the participant will be stored and used for purposes that are connected with executing the event only, especially with regard to data necessary for the payment process (§ 28 BundesdatenschutzG). By registering the participant agrees that his/her data is stored for that purpose.

(2) Participants agree that photos, video material, and interviews made in connection with his/her participation in the event can be broadcast and published on TV, the radio, in print, books, photo copies (video footage, video tapes, etc.) without fees. Moreover, participants agree that personal data can be provided to a third party commissioned by the organizer for the purpose of mailing photos of participants on the course or at the finish. However, participants do hereby not declare that they may want to buy such a photo.

(3) Participants agree that personal data can be provided to a third party for the purposes of timekeeping, compiling lists of the results, as well as publication of those lists on the Internet.

(4) The participant agrees that his/her last name, first name, year of birth, team name, starting number, and results (standings, times) may be published in all print media relevant to the event (participant list, scoring board) and in all electronic media such as on the internet.
